The plaintiff underwent thyroidectomy. The pathology was read as negative for malignancy. Following surgery, he was discharged and was followed medically by his physicians. Fifteen years later, he was diagnosed with metastatic thyroid cancer from which he subsequently died. The pathology at the initial surgery had been misread and the plaintiff never received the appropriate treatment for his cancer before it had spread to many other organs, causing his death.
