Salesman Settles Suite for $2.1 Million

Hackensack, N.J. - A $2.175 million cash settlement was made yesterday in a suit by a 40-year-old salesman who suffered permanent brain damage when his car was struck in the rear by a trailer truck at a traffic light in South Brunswick, NJ., in June, 1977

The settlement included $1.775 million for the victim, Robert Greene, father of a 10-year-old boy and twin 8-year-old girls, and $400,000 to his wife, Margaret of Fair Lawn, N.J.

Court OK's settlement of $2.1M

Hackensack - a $2.1 million personal injury settlement, believed to be the largest in the state, was approved Tuesday in the case of a former Fair Lawn man who became totally disabled following a 1977 car accident.

Superior Court Judge Theodore W. Trautwein approved the settlement in behalf of Robert Greene, 40 and his wife Margaret.

Greene was awarded $1,775,000. His wife will receive $400,000.

A former sales manag3er with national Freight Lines of Vineland, Greene sustained permanent damage to his brain stem. He has been declared incompetent and is now permanently confined at the Lyons Medical Center in Lyons.

GREENE WAS DRIVING a car on June 24, 1977 in South Brunswick when he stopped for a traffic light, according to his attorney, E. Carter Corriston of Hackensack. A tractor trailer truck, driven by Emmet C. Pearsall of Jersey City and owned by N.J. Trucking of Cliffwood, hit and totally destroyed Greene’s car, Corriston said.

Names as defendants in the suit were: The owner and operator of the truck: D.K. Trucking of Avenel; and Crouch Motor Freight Systems of Jersey City.

Couch Motor Freight Systems had leased its interstate commerce rights to D.K. Trucking the date of the accident. Corriston said that D.K. Trucking had then hired J.V.J. Trucking to operate the tractor trailer.

Attorney John J. Breslin, Jr. who represented Mrs. Greene in the case, said that at the time of the accident, the couple and their three children lived in Vineland but had been lifelong residents of Bergen County.

Record $2 million awarded in crash

A Bergen County man, who was permanently disabled in a car accident and his wife have been awarded $2,175,000 in a settlement that his lawyer says is the highest ever recorded in a personal injury case in the county.

The settlement, approved yesterday by superior Court Judge Theodore W. Trautwein in Hackensack, stems from a June 1977 accident in South Brunswick. The accident caused permanent brain damage to 40-year-old Robert Greene who was general sales manager of National Freight Lines of Vineland.

Greene, confined to the Veterans Administration Medical Center in Lyons, will receive $1,775,000 his attorney, E. Carter Corriston said. His wife, Margaret, who lives in Fair Lawn, was awarded $400,00 to support herself and the Greenes’ three children, her attorney, John J. Breslin Jr. said.

Greene, who has been declare mentally incompetent as a result of the accident, was stopped at a traffic light when his car was struck in the rear by a tractor trailer driven by Emmett Pearsall of Jersey City and owned by J.V.J. Trucking of Cliffwood, Corriston said. Greene was hospitalized with bodily injures, burns and permanent damage to his brain stem, Corriston said. Green will be hospitalized for the rest of his life, the attorney added.

Mrs. Green, 40, who will be appointed her husband’s guardian, testified that the funds from the settlement will be placed in trust for her husband, her 10 year old son and her twin eight year old daughters. Breslin said the Greenes had been lifelong residents of Bergen Count before moving to Vineland.

Mrs. Green said that she was conferred with attorneys and with bank officials about the settlement.

Peter Feehan, a Hackensack attorney appointed by the court as Greene’s temporary guardian while the settlement was being negotiated, testified that he had “no qualms of recommending” the terms of settlement to Mrs. Greene.

Other defendants in the settlement were Crouch motor Freight Systems of Jersey City and D.K. Trucking of Avenel. Crouch, which will pay $1,8 million of the settlement, leased its Interstate Commerce Commission rights to D.K. to operate on the date of the accident. D.K. Trucking in turn, hired J.V.J. and Pearsall to operate the tractor-trailer.

Corriston said that the settlement was one of the largest in New Jersey and surpassed a recent Bergen County case in which a jury awarded $1 million to the widow of a Saddle Brook fireman, who died five days after a November 9, 1973 gas tank explosion. Two other Saddle Brook firemen, who also were injured in the explosion, received $500,000 each.

Record injury award made

A $2.1 million settlement - the highest for personal injury in Bergen County’s history - was approved Tuesday for a totally disabled Fair Lawn man and his wife.

The settlement on behalf of Robert Greene, 40 and his wife, Margaret, was the result of a 1977 auto accident in Middlesex County in which Greene suffered permanent brain damage, according to his attorney, E. carter Corriston of Hackensack.

The agreement was reached between Corriston, Mrs. Greene’s attorney, John Breslin, and attorneys representing the operator and owner of the truck which struck Greene’s vehicle as well as two other companies involved I the hiring o f the truck.

Greene was operating a car on June 24, 1977, in South Brunswick when he stopped for a traffic light, according to Corriston. A truck owned by J.V.J. Trucking of Cliffwood and operated by Emmett Pearsall of Jersey City then struck the rear of Greene’s vehicle, totally destroying it.

As a result of the accident, Greene, general sales manager of National Freight Lines of Vineland was immediately hospitalized and sustained permanent brain stem damage.

Greene has since been judged as incompetent and is totally disabled and permanently confined at Lyons medical Center in Lyons.

Under the settlement-approved by Bergen County Superior Court Assignment Judge Theodore Trautwein-Pearsall and J.V.J. Trucking must pay $100,000 to Greene and his wife.

In addition to the operator and owner of the truck, the Greenes sued D.K. Trucking of Avenal, which must pay $250,000, and Crouch Motor Freight Systems of Jersey City, which will pay the remaining $1.8 million.

Crouch Motor Freight Systems had originally leased Interstate Commerce Commission rights to D.K. Trucking to operate the truck on the day of the accident.

Corriston said D.K. Trucking in turn had hired J.V.K. Trucking and Pearsall to operate the tractor-trailer on that day.

Greene was awarded the sum of $1.7 million while his wife will receive $400,000.

Before approving the settlement, Trautwein listened to the testimony of Mrs. Greene, who said she panned to use the $400,000 to establish trust fund for the couple’s three children.

Mrs. Greene currently lives in Fair Lawn with the children, a 10-year-old boy and twin eight-year-old girls.

Corriston said this is the largest personal injury settlement in the history of Bergen County and one of the largest ever in New Jersey.

The award surpassed the recent $1 million verdict by a Bergen County jury to the widow of a volunteer fireman killed in a Saddle Brook explosion several years ago. The same jury had also awarded two surviving Saddle Brook volunteer firemen severely burned in the explosion approximately $200,00 each.

At the time of the accident, the Greenes resided in Vineland, Breslin said, although the couple had previously lived in Bergen County.

The Greenes had also sued the U.S. Steel Corp on the grounds that the tractor-trailer had been en route to Pennsylvania to pick u steel when the accident occurred. However the corporation was excused from the case before the settlement was reached.
